Terms and Conditions of Use (TCU)

1. Acceptance and Access
By accessing Quanta AI platforms, APIs, AI agents, or interfaces, the User accepts these GTCU. Access may require authentication; the User is responsible for keeping credentials confidential.
2. Account, Security, and Support
The User must maintain accurate information, protect credentials, and notify any unauthorized access. Quanta AI applies reasonable security measures and provides support according to the applicable SLA.
3. Authorized and Prohibited Use
It is prohibited to use the Services to: (i) violate the law, FADP/GDPR, or third-party rights; (ii) distribute unlawful content; (iii) compromise security; (iv) perform unauthorized mass extraction or reverse engineering; (v) develop weapons or prohibited surveillance systems. Quanta AI may suspend an account in case of violation.
4. Content and Ownership
Content generated by AI agents is provided to the Client/User under contractual terms; the User guarantees rights to provided content and respects licenses. Quanta AI retains ownership of software, models, and interfaces.
5. Personal Data and Confidentiality
Quanta AI processes personal data in accordance with its Privacy Policy and applicable laws (FADP/GDPR). Purposes, legal bases, retention periods, recipients, and transfers are described in said policy. A Data Processing Agreement (DPA) applies to professional clients.
6. Data and Retention
Technical logs and usage metadata may be retained for security, maintenance, and improvement purposes. Retention periods are proportionate and documented; the User may exercise rights under FADP/GDPR via indicated channels.
7. Subcontractors and Third-Party Terms
The use of technological subcontractors (e.g., Microsoft Azure) is necessary. The User accepts that certain features are subject to these providers’ terms; Quanta AI strives to ensure compatibility and compliance.
8. Availability and Changes
Quanta AI aims for high availability; interruptions may occur for planned maintenance or incidents. Quanta AI may modify Services and GTCU, notifying major changes with reasonable notice.
9. Liability and Limitations
Services are provided “as is.” Quanta AI is not responsible for decisions based on AI outputs; the User remains responsible for their use. Liability limitations apply as per GTCS.
10. Governing Law and Jurisdiction
Swiss law applies; jurisdiction is at Quanta AI’s registered office (NE), subject to mandatory provisions.
In case of any discrepancy between language versions, the French version shall prevail.
